Agreement of Terms Concerning
The Purchase of StockRaptor Software

Thank you for ordering StockRaptor software.

All of your purchases are governed by the Terms of Use of the StockRaptor web site, "the Site", and the Terms of Use contained in any evaluation copies of StockRaptor you have used or obtained, this document, the conditions, notices and consents that are provided or otherwise obtained in connection with the use of the Site, all of which are incorporated herein by this reference and are collectively called "the Terms". As used in the Terms "you" are an individual acting on your own behalf, or "you" are an agent of a person or entity that has authorized you to act on that person's or entity's behalf.

By placing an order through any medium for StockRaptor products, or any products made available through the Site, you agree as follows:

All orders placed by you are considered to have been processed, accepted by StockRaptor, and become final at the time they are received by StockRaptor, including receipt by any StockRaptor order processing agent. Once your order has been processed it may NOT be modified or cancelled for any reason.

You affirm and represent that all information provided by you when placing your order is true and correct. You acknowledge that you have been offered 30 days to evaluate the software at no cost or obligation and you affirm and represent that, regardless of the actual time spent by you evaluating the software, you have made all evaluations you deem necessary to satisfy yourself with the product and its suitability to your purposes.

In the event the StockRaptor software you have ordered arrives, or has arrived in a damaged form, StockRaptor, in its sole and absolute discretion may either repair or replace the damaged software or refund the purchase price you paid, less any shipping and handling charges.

In the event that StockRaptor does not receive payment in full from you for the product(s) you have ordered, you agree to pay, in addition to the full amount of your order, all costs of collection, including attorney's fees.

If any part of the Terms is determined to be invalid or unenforceable, by any court having jurisdiction over the matter, then that Term shall be deemed to have been superceded by a valid and enforceable provision that effects the intent of the original Term.

The Terms, including any related consents or agreements between you and StockRaptor, collectively constitute the entire agreement between you and StockRaptor, concerning this order, and supercede any prior or contemporaneous communications and proposals, however made, between you and StockRaptor.
