The terms and conditions will always be referenced at the bottom of each chart you create and the reference will be printed with each chart you choose to print.

It is the intent of StockRaptor that you accept the site and its software as a tool that you will use to assist you in making decisions about stocks you select to analyze. As with any other tool it is you, the user, who makes the decision on whether or not to use the tool, how to use the tool, and whether to misuse or abuse the use of the tool. This being the case YOU, and NOT StockRaptor, are responsible for the results obtained by you from the use, misuse or abuse of StockRaptor.

You assume total responsibility and risk for your use of StockRaptor and the Internet. StockRaptor does not make, and has not made any express or implied warranties, representations, endorsements of any kind or nature, including, but without limitation, warranties of merchantability or fitness for a particular use, uses or purpose. Some jurisdictions do not allow the exclusion of implied warranties, so the preceding exclusion may not apply to you.

In no event shall StockRaptor be liable for any harm or damages whatsoever, and in particular StockRaptor shall not be liable for special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, loss of any funds, or loss of use, arising out of or related in any way to any StockRaptor web site or the information contained in it, whether such harm or damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise.

StockRaptor may make available to you, or you may be able to access through StockRaptor or Third Party Service providers located on, or accessed by you through StockRaptor, data or information which you choose to use or not use in conjunction with your use of StockRaptor. StockRaptor assumes no liability resulting from the use of the data or information by you for any purpose. All data or information is provided on an "AS IS, AS AVAILABLE AND WITH ALL FAULTS" basis and StockRaptor shall not be liable for any actions taken in reliance or otherwise based upon the data or information.

In the event that a court or arbitrator or arbitration panel, as the case may be, should determine that the exclusion or limitation of liabilities set forth in this agreement, or any portion thereof, are unenforceable for any reason, you expressly agree that under no circumstances will the total liability of StockRaptor and its employees, distributors, agents or affiliates, to you or to any party claiming by or through you, including persons, firms or entities claiming to be members of a class to which it is asserted you and they belong, shall aggregate no more than $100 (U.S.).

Regardless of the form of action and regardless of the theory upon which it is based. The right to monetary damages, as stated above and as agreed to by you, by your using the site, its software or any of its associated materials, shall be in lieu of all other remedies to which you may otherwise entitled from StockRaptor.

No materials from the StockRaptor software or its web site or any web site owned, operated, licensed or controlled by StockRaptor may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way unless expressly and in writing permitted by StockRaptor. You may download or print material displayed on StockRaptor for non-commercial, personal use only. You may not use, distribute, modify, transmit, or post the content of StockRaptor for public or commercial purposes without first obtaining the express, written consent of StockRaptor.

In the event you download software from the StockRaptor web site, the software, including any files, images incorporated in or generated by the software, and data accompanying the software, collectively called the "software", are licensed to you by StockRaptor subject to these terms and conditions of use. StockRaptor does not transfer any rights, title or interest in or to this site or the software to you. The right title and interest in and to this site and the software is retained exclusively by StockRaptor. You may not redistribute, sell, decompile, reverse engineer or disassemble the software.

You agree to indemnify, defend and hold harmless StockRaptor, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the web site or software from and against all losses, costs, expenses, and damages, including actual attorneys fees incurred in the investigation of any claim, and preparation thereof for trial and trial, including appeal from any judgment and any bankruptcy proceedings involved therewith.
